{"id":1120,"date":"2026-10-13T22:58:21","date_gmt":"2026-10-13T19:58:21","guid":{"rendered":"https:\/\/apetlaw.gr\/?p=1120"},"modified":"2026-10-13T23:20:35","modified_gmt":"2026-10-13T20:20:35","slug":"forest-maps-and-hellenic-cadastre","status":"publish","type":"post","link":"https:\/\/apetlaw.gr\/en\/forest-maps-and-hellenic-cadastre\/","title":{"rendered":"Forest Maps and the Hellenic Cadastre"},"content":{"rendered":"\n\n\t<section class=\"section articles-section-en\" id=\"section_1049242117\">\n\t\t<div class=\"section-bg fill\" >\n\t\t\t\t\t\t\t\t\t\n\t\t\t\n\n\t\t<\/div>\n\n\t\t\n\n\t\t<div class=\"section-content relative\">\n\t\t\t\n\n<h1 dir=\"ltr\" style=\"text-align: center;\"><strong>Forest Maps and the Hellenic Cadastre<\/strong><\/h1>\n<h2 dir=\"ltr\"><strong>A guide for owners: reforested farmland, corrections to cadastral entries, and when court action is needed<\/strong><\/h2>\n<p dir=\"ltr\">Thousands of property owners in Greece face a double problem: the forest maps on one side and the first registrations of the Hellenic Cadastre on the other.<\/p>\n<p dir=\"ltr\">One basic distinction has to come first. Whether land is forest is one question. Who owns it is another.<\/p>\n<p dir=\"ltr\">A forest map records the character of land under forestry legislation. It is not, by itself, a title of ownership. Ownership is a separate matter. It is decided on the basis of title deeds and the lawful modes of acquiring ownership. Where relevant, it is also decided under the special rules on State ownership.<\/p>\n<p dir=\"ltr\">In a good number of cases the legal framework now allows the matter to be resolved administratively or through the Cadastre, before it reaches the courts.<\/p>\n<h3 dir=\"ltr\">1. The presumption of State ownership does not apply everywhere<\/h3>\n<p dir=\"ltr\">Article 62(1) of Law 998\/1979 creates a presumption that forest land belongs to the Greek State. The same provision, however, excludes significant areas.<\/p>\n<p dir=\"ltr\">The presumption does not apply in the Ionian Islands, Crete, the Prefectures of Lesvos, Samos, Chios and the Cyclades, Kythira and Antikythira, or the Mani area. Nor does it apply in the Dodecanese, except on the islands where the cadastral regulation is in force.<\/p>\n<p dir=\"ltr\">This exception matters a great deal in practice.<\/p>\n<p dir=\"ltr\">Where the presumption does not apply, the fact that land appears as forest is not enough to prove that the State owns it. The question becomes whether the State holds its own title, or can base its ownership on another lawful mode of acquisition.<\/p>\n<p dir=\"ltr\">For this reason, every case should begin by establishing exactly where the property lies and which ownership regime applies there.<\/p>\n<h3 dir=\"ltr\">2. &#8220;Reforested farmland&#8221;: what Article 67 of Law 998\/1979 now provides<\/h3>\n<p dir=\"ltr\">Article 67 of Law 998\/1979, as replaced by Article 93 of Law 4915\/2022, is of particular importance. It concerns land that was once farmed and later became forest because it was abandoned.<\/p>\n<p dir=\"ltr\">Under paragraph 1, the State does not assert ownership rights over land that:<\/p>\n<ul dir=\"ltr\">\n<li>appears in agricultural use in the 1945 aerial photographs or, where these are unclear, in the 1960 aerial photographs, and<\/li>\n<li>was reforested later, whatever form it has taken since.<\/li>\n<\/ul>\n<p dir=\"ltr\">The rule applies provided the State cannot base ownership on a title. The same provision also revokes administrative eviction orders already issued for such land.<\/p>\n<p dir=\"ltr\">This is especially relevant to owners of old fields that now appear on the maps as forest land.<\/p>\n<p dir=\"ltr\"><strong>What does this mean in practice?<\/strong><\/p>\n<p dir=\"ltr\">An old aerial photograph can be key evidence of the land&#8217;s original use. It does not follow, however, that every property that looks agricultural in 1945 automatically becomes private.<\/p>\n<p dir=\"ltr\">The assessment takes into account:<\/p>\n<ul dir=\"ltr\">\n<li>how the property appears in the aerial photographs,<\/li>\n<li>its later reforestation,<\/li>\n<li>any title held by the State,<\/li>\n<li>the owner&#8217;s title deeds and other evidence.<\/li>\n<\/ul>\n<p dir=\"ltr\">For reforested farmland, then, a deed dating from 1945 or 1960 is not necessarily required. The old aerial photograph mainly proves the historical use of the land. Ownership is examined on its own evidence.<\/p>\n<h3 dir=\"ltr\">3. The special correction procedure under Article 19(5) of Law 2664\/1998<\/h3>\n<p dir=\"ltr\">Article 15 of Law 5142\/2024 is one of the most significant recent changes. It added paragraph 5 to Article 19 of Law 2664\/1998. This created a special procedure for correcting a cadastral entry in favour of the State or the Forest Service, so that it passes to the true holder of the right.<\/p>\n<p dir=\"ltr\">The local Cadastral Office makes the correction without a court judgment. All four statutory conditions must, however, be met together:<\/p>\n<ol dir=\"ltr\">\n<li><strong>Entry in favour of the State.<\/strong> The cadastral records must show the Greek State or the Forest Directorate of the Ministry of Environment and Energy as the holder.<\/li>\n<li><strong>Link to the forest map.<\/strong> One of the following must apply:\n<ul dir=\"ltr\">\n<li>the Objections Examination Committee (\u0395\u03a0.\u0395.\u0391.) upheld an objection to the forest map and two months have passed since the decision was issued,<\/li>\n<li>the property lies outside the areas covered by a ratified forest map,<\/li>\n<li>in a special case concerning Keratea, a relevant certificate from the Forest Service exists.<\/li>\n<\/ul>\n<\/li>\n<li><strong>The owner&#8217;s title.<\/strong> The applicant&#8217;s right must derive from a public deed recorded at the Land Registry before the cadastral survey was completed. If it was recorded later, it must rest on an earlier deed recorded before completion.<\/li>\n<li><strong>Basis of the entry.<\/strong> The entry in favour of the State must rest solely on the presumption of State ownership of forest land, or on certain old court judgments specified in the law.<\/li>\n<\/ol>\n<p dir=\"ltr\">If the conditions are not met, the application can only be rejected by a reasoned decision. It does not need to be served on the Greek State.<\/p>\n<p dir=\"ltr\">This is a valuable remedy, but it does not apply automatically. It must first be checked whether the case actually falls within the provision.<\/p>\n<h3 dir=\"ltr\">4. When might court action be needed?<\/h3>\n<p dir=\"ltr\">Recourse to the courts has not been abolished. It may be needed where:<\/p>\n<ul dir=\"ltr\">\n<li>there is a substantive dispute over ownership,<\/li>\n<li>the State claims a property right of its own,<\/li>\n<li>the conditions for the out-of-court procedures are not met,<\/li>\n<li>the administrative procedure does not resolve the matter,<\/li>\n<li>a court ruling is required on an inaccurate first cadastral registration.<\/li>\n<\/ul>\n<p dir=\"ltr\">In administrative disputes, an application for annulment may be brought before the competent administrative court, where the conditions of the relevant legislation are met. The well-known 60-day time limit should not, however, be treated as a general rule for every forest map case. It must be established exactly which administrative act is being challenged and when the time limit starts to run.<\/p>\n<p dir=\"ltr\">Where the issue is purely one of ownership and cannot be resolved through the administrative or cadastral procedures, proceedings before the civil courts may be required.<\/p>\n<h3 dir=\"ltr\">5. Five things every owner should check<\/h3>\n<p dir=\"ltr\">Before starting any procedure, an owner should have a complete file.<\/p>\n<p dir=\"ltr\"><strong>1. The forest map<\/strong><br \/>How has the land been classified? Has the map been ratified? Was an objection filed?<\/p>\n<p dir=\"ltr\"><strong>2. The \u0395\u03a0.\u0395.\u0391. decision<\/strong><br \/>If objections were filed, which part was upheld and which was rejected?<\/p>\n<p dir=\"ltr\"><strong>3. The cadastral entry<\/strong><br \/>Who is shown as the holder? What is the stated basis of the entry? Is it an entry in favour of the State, &#8220;unknown owner&#8221;, or something else?<\/p>\n<p dir=\"ltr\"><strong>4. The title deeds<\/strong><br \/>What is the title of acquisition? Is there an unbroken chain of title from previous owners? Were the deeds correctly recorded or registered? When were they recorded?<\/p>\n<p dir=\"ltr\"><strong>5.
